Terms of Service

1. Agreement to Terms

By accessing or using HVACAutomate ("Service"), operated by HVACAutomate ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HVACAutomate provides automation template software, setup guides, and downloadable workflow blueprints designed for HVAC businesses. Templates are intended to be used with third-party automation platforms (Make.com, Zapier, etc.) that are not operated by HVACAutomate.

3. Accounts and Access

  • Account access is granted via a secure, time-limited magic link sent to your email address.
  • You are responsible for maintaining the security of your access links and preventing unauthorized access to your account.
  • You must provide accurate information when signing up and keep it current.
  • One account per person or business entity. You may not share access credentials.

4. Subscriptions and Billing

  • Billing: Subscriptions are billed monthly. Your card is charged on the same date each month.
  • Free Trial: If a free trial is offered, you will not be charged until the trial period ends. Cancel before the trial ends to avoid charges.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period. No partial refunds for unused time.
  • Price Changes: We will provide 30 days' notice before any price increase. Continued use after the notice period constitutes acceptance of the new price.
  • Payment Processing: All payments are processed by Stripe. We do not store payment card information.

5. Refund Policy

We offer refunds in the following circumstances:

  • Within 14 days of initial purchase: Full refund if you have not accessed the member dashboard or downloaded more than 2 templates.
  • Service outage: Pro-rated refund if the Service is unavailable for more than 24 consecutive hours in a billing period.

To request a refund, email hello@hvacautomate.com with your account email and reason. Refunds are processed within 5–10 business days.

6. Acceptable Use

You agree not to:

  • Resell, sublicense, or redistribute HVACAutomate templates or content without written permission (Agency plan white-label rights are explicitly permitted)
  • Use the Service to send spam, unsolicited commercial messages, or harass recipients
  • Attempt to reverse engineer, copy, or replicate our template library for competitive purposes
  • Use the Service for any illegal purpose or in violation of applicable laws, including TCPA regulations governing SMS communications
  • Share your account access with others outside your business

7. SMS and Communication Compliance

You are solely responsible for ensuring that your use of HVACAutomate templates complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state laws. You must only send automated messages to contacts who have provided appropriate consent. HVACAutomate is not responsible for your compliance with communication laws.

8. Intellectual Property

All content, templates, blueprints, setup guides, and materials provided by HVACAutomate are owned by HVACAutomate and protected by copyright. Your subscription grants you a non-exclusive, non-transferable license to use the templates for your own business operations. This license does not permit resale or redistribution (except as permitted under the Agency plan).

9. Third-Party Services

Our templates are designed for use with third-party platforms including Make.com, Zapier, Twilio, Google Workspace, and others. HVACAutomate is not affiliated with, endorsed by, or responsible for these platforms. Your use of third-party services is governed by their respective terms and subject to their fees.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY SPECIFIC BUSINESS RESULTS. AUTOMATION TEMPLATES ARE PROVIDED AS STARTING POINTS AND MAY REQUIRE CUSTOMIZATION FOR YOUR SPECIFIC BUSINESS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HVACAUTOMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your access to the Service will end at the close of your current billing period.

13. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration rather than in court, except for small claims court matters.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
